SPDES MS4 Information
According to the federal law commonly known as Stormwater Phase II, permits will be required for stormwater discharges from Municipal Separate Storm Sewer Systems (MS4s) in urbanized areas and for construction activities disturbing one or more acres. To implement the law, the Department has developed two general permits, one for MS4s in urbanized areas and one for construction activities. The permits are part of the State Pollutant Discharge Elimination System (SPDES). Operators of regulated MS4s and operators of construction activities must obtain permit coverage under either an individual SPDES permit or one of the general permits no later than March 10, 2003 or prior to commencement of construction.
Update: New York State DEC has updated the Notice of Intent for the SPDES General Permit for Stormwater Discharges from Construction Activity to address the Runoff Reduction criteria in the 2010 version of the New York State (NYS) Stormwater Design Manual. The new Notice of Intent is available as a PDF under "Forms" header on the Stormwater Permit for Construction Activity webpage.
DEC will not accept the old NOI form after October 1, 2013.
In addition, DEC has developed worksheets to help owners/designers account for runoff reduction techniques and complete the new questions that were added to the Notice of Intent. The worksheets are available as Excel spreadsheets under the "Additional Tools" header on the Construction Stormwater Toolbox webpage.
(August 2010) New York State DEC has updated the New York State Stormwater Management Design Manual. This manual is a key component of the Phase II SPDES general permit for stormwater runoff from construction activities. The Chemung County Stormwater Coalition strongly urges designers to begin using this updated version.
Contractors, before doing any work or planning of development, please contact the Stormwater Officer (PDF) in the municipality where the construction activity will be taking place.

Construction Activity Training Sessions for Contractors and Developers dealing with Stormwater, Erosion and Sediment Control
These approved 4 hour training sessions are required for all companies working under NYSDEC's SPDES Stormwater Permit. Next session is noted on the Stormwater homepage.
Please Note: Beginning on May 1, 2010 the New York State Department of Environmental Conservation Construction Activity Permit, GP-0-10-001 requires all developers, contractors and subcontractors to identify at least one trained individual from their company who will be responsible for implementing the Stormwater Pollution Prevention Plan. The individuals responsible for installing, constructing, repairing, maintaining or inspecting erosion and sediment control measures or constructing post-construction stormwater management practices at SPDES-permitted construction sites are required to attend this course every three years.

Stormwater Pollution Prevention Plan (SWPPP)
A Stormwater Pollution Prevention Plan (SWPPP) (PDF) is required when the project will impact, disturb or expose one or more acres of soil. The SWPPP Checklist will ensure the completeness of the SWPPP before submitting it with the Notice of Intent (NOI) to the municipality for review and acceptance.
The SWPPP Acceptance Form is used by each designated MS4 in Chemung County. The SWPPP Acceptance form must be signed by the Municipality before submitting the NOI and SWPPP to the New York State DEC in Albany.
Please check with the local Stormwater Officer in the municipality your project is located for more information on the SWPPP and NOI.
